Muckler Law Successfully Defends Constitutional Protections in Traffic Stop Case

Muckler Law, LLC recently won a legal victory on behalf of our client, Mr. Dashawn Brown, in a case that tested constitutional protections and procedural fairness.

In **Commonwealth of Pennsylvania vs. Dashawn Brown**, the court found in favor of Mr. Brown following the defense's Omnibus Pre-Trial Motion. Led by Attorney Matthew T. Muckler, the defense successfully challenged the legality of the traffic stop and subsequent search that formed the basis of the charges against Mr. Brown.

The defense argued:

1. **Insufficient Evidence for the Traffic Stop**: The stop was based on allegations of illegal window tinting, which the court found lacked sufficient probable cause to justify the action. The defense also argued that the stop appeared pretextual in nature.

2. **Violation of Fourth Amendment Protections**: The extended detention of Mr. Brown and his co-defendant for over two and a half hours, without a valid warrant or proper consent, was an unconstitutional seizure. This critical point underscored the violation of Mr. Brown's rights under both the U.S. Constitution and the Pennsylvania Constitution.

3. **Flawed Search Procedures**: Using new case law, the defense argued that without more than the smell of marijuana, a search warrant cannot be justified. The defense highlighted that the trooper failed to inquire about whether any occupant of the car had a medical marijuana card or the possibility of prior lawful use in another jurisdiction.

The Court ultimately ruled that because the Commonwealth could not show probable cause from the four corners of the search warrant, the warrant and any drugs seized as a result thereof, must be suppressed. This ruling reinforces essential constitutional protections against unlawful searches and seizures.
